Diana Zubiri's Early Films Will Become Illegal Under Proposal

As is well known, Diana Zubiri is a popular actress in the Philippines and was born on April 15, 1985.

Diana was just 16 when she starred in her first film, "Itlog", a sexually oriented feature released in 2002. She shows total front and back nudity in it. She touches her breasts in the shower, and a second time later after she takes off her robe. There is also a scene where a man is on top of her having simulated sexual intercourse with her. He touches and kisses her breasts.

She was also under 18 when she made "Bakat", released in September 2002. She shows nudity here, but no sexual activity.

Diana was still no older than 17 when she made "Kasiping", which was released in November 2002. This was her second sexually oriented flick. She shows her breasts and buttocks in several scenes. One of these scenes, a sex scene with her lover, shows him on top of her as they fall on to the bed and start to simulate intercourse. Later they make out in the shower. The guy washes and touches her buttocks, which are seen along with her breasts, and then he touches more of her body and viewers are led to believe that he is giving her oral sex. There is a third scene where they make out and he gets on top of her and touches her breasts.

The filmmakers didn't know that Diana hadn't yet turned 18. A recent proposal seeks to create a law in the Philippines that will ban dealings with "child pornography".  The bill includes everybody younger than 18 in the definition of "child".

 This proposal would make two or three of Diana Zubiri's first three films illegal to sell, buy, rent, download, or own.

The writers of the proposal think the law in Ireland is the best approach. When it comes to visual materials like films and magazines, here's what Irish law bans:

" 'Child pornography means:
a) any visual representation 

  1. that shows or in a case of a document, relates to person who is or is depicted as being a child and who is engaged in or is depicted as being engaged in explicit sexual activity,
  2. that shows or in the case of a document, relates to a person who is or is depicted as being a child and who is or is depicted as witnessing any such activity by any person or persons, or

"Child rights advocates have drafted the first law banning child pornography from the Philippines, which was inspired by the 10-year-old child protection laws of predominantly Catholic Ireland.
... Deirdre MacCarthy, an Irish lawyer and a consultant for the People's Recovery, Empowerment and Development Assistance (Preda) Foundation in Olongapo City, said Irish laws are simple and straightforward, and may be a good model for the Philippine draft law against child pornography."
 

Cabreza's article interviewed Louie Maranan, executive director of the Philippine Legislators' Action Committee for Children (PLACC). Cabreza wrote "He said law enforcers mistakenly assume that child pornography deals with three- to six-year-old children, when 16- and 17-year-old teenagers are often the pornographers' real victims."

Does Diana consider herself a "victim", since she starred in sexual films as young as 16?
Does Diana want her fans to go to jail for owning her early films?
Does something magically happen when somebody turns 18 that suddenly makes everything OK and nobody is a "victim" anymore?
Diana made "Liberated" right after she turned 18. If she made it just a few weeks or months earlier, it's wrong?
Does the age of consent of 18 in the Philippines make sense?

"Itlog" and "Kasiping" both show Diana having what looks like, and is represented as being, sexual intercourse.

In "Itlog", Diana showed her pubic hair after she took off her robe, and since that's in a sexual context (she touches her breasts with her eyes closed so as to arouse herself) it could be perceived as being "for a sexual purpose".

For these reasons, it is clear that "Itlog" and "Kasiping" will be contraband in the Philippines if the proposed measure is not challenged or amended either before or after it goes into effect, and if they didn't create a registry of exempted materials.

There seems to be conflicting information about whether Diana totally enjoyed what she was doing when acted and posed nude at the ages of 16 and 17.

FHM Philippines asked her "So do you ever get turned on during a love scene?" and she replied "Of course, it’s work, but you can’t help getting carried away sometimes. Here in Bakat, when Rodel kissed me the first time, I must admit I got turned on because he was an excellent kisser! (laughs)"

Regarding "Itlog", she said her first naked scene was in the shower, and after that they had a sex scene.  She said "It was good that he was wearing shorts so it was fine when he went on top of me. He also simulated performing oral sex with me under the sheets. I felt so vulnerable because there were people on the set watching. But after that, I started to get used to it."

"... In a rare video footage, Diana Zubiri is seen posing nude before a bunch of tabloid photograpers in a studio filled with onlookers. An innocent looking Diana Zubiri tried to hide the embarassment as she coolly posed before the cameras, doing every pose she was told to do."

So she got "turned on" by being nude before cameras, and did so 6 times before she turned 18 (for the 3 films, the June 2002 and December 2002 issues of FHM Philippines, and the March 2003 issue of People Asia), and her career got started by all these things, yet she sometimes felt embarrassed or vulnerable and viewed what she was doing as just work.  She doesn't seem to have an exhibitionistic type of personality.

But I am pretty sure that she would NOT want anybody to become a criminal simply for looking at her photos and films! As far as I know she made the films by her own free will.

Somebody should interview Diana and find out what she thinks about all this, and about the proposed law.

Remember, the law would not differentiate between abusive films where young children are raped and films where actresses are teenagers under 18 and are being paid for their work.  If it showed something that's prohibited, such as full frontal nudity, pretend oral sex, or pretend sexual intercourse, it would be illegal, regardless of the circumstances under which it was made.
